Terms of Service

Please read this Terms of Service agreement carefully. Get Fieldy (“Fieldy,” “we,” “us,” or “our”) owns and operates the website located at https://getfieldy.com (the “Website”), including any subdomains used in connection with or related to it, and the Fieldy mobile application made available through third-party marketplaces (the “App”).

These Terms of Service (as amended from time to time, the “Terms”) apply to all users of the Website, including users who upload content, use services through the Website, download the App, or simply view content available on or through the Website.

1. Registration of Accounts

a. Accounts  

To use the Service, you must create and maintain an account with us. You are required to provide accurate and complete information during registration and update it promptly if anything changes. We reserve the right to suspend or terminate your account if we determine that the information you have provided is inaccurate or incomplete.

Only authorized users may access and use the Service through your account. You are responsible for all activity that occurs through your account. Keep your username and password secure and ensure your authorized users do the same. Report any unauthorized use or security breaches to us immediately. You agree to take all reasonable steps to prevent unauthorized access and to cooperate with Fieldy in preventing or addressing such access.

b. Qualification

To use the Service, you must be at least the age of majority in your country (typically 18 or 19). By accepting these Terms, you confirm that:

  • You are at least the legal age of majority in your jurisdiction.
  • You have not previously been suspended or removed from the Service.
  • Your registration and use of the Service comply with all applicable laws and regulations.

c. Organizational Units 

If you are entering into this agreement on behalf of a company or other legal entity (a “Corporate Entity”), the individual accepting this agreement represents that they are authorized to bind the Corporate Entity to these Terms. 

If you allow affiliates to use the Service, you agree:

  • You remain fully responsible and liable for all acts and omissions of your affiliates and their users.
  • Your affiliates may access your account data, and Fieldy will not be responsible for enforcing access restrictions between you and them.

The term “Affiliate” refers to any entity you control, directly or indirectly, through ownership or management authority. We may request verification that all licenses purchased by you are being used only by you and your Affiliates for a single business operation.

If you operate multiple businesses, you must purchase separate licenses and enter into separate agreements for each. Failure to comply may constitute a violation of this Agreement.

2. Support

If you are a paying customer, Fieldy will provide standard technical support in accordance with its published support policies, subject to any specific agreement you may have for support.

3. Fees and Payment

a. General Payment Terms

Some features of the Service may require fees (including applicable taxes). You will be able to review the charges before making a payment. All fees are in U.S. dollars and non-refundable unless agreed otherwise.

Fieldy reserves the right to change the accepted payment method at any time with prior notice. You must keep your account and payment information updated. If you agreed to a minimum number of Managed Technician licenses (the “Minimum License Level”), you must pay for at least that number during your subscription term.

You may purchase additional licenses at the same rate. Monthly charges are calculated based on the number of users at the start of each month, with prorated charges for additions and no refunds for reductions. All fees under this Agreement are non-refundable.

You acknowledge that purchasing the Service is not dependent on the release of any future features or functionality unless expressly stated in writing

b. Pricing

Fieldy reserves the right to determine pricing for the Service and will make reasonable efforts to keep its website updated. We encourage you to check the website for current pricing. Price changes will be communicated in advance and take effect upon notice. Fieldy may offer promotional pricing or features to certain customers at its discretion. These do not apply to you unless specifically offered.

c. Subscription Services

If you enroll in a subscription (“Subscription Service”), you authorize Fieldy to charge the applicable fees on a recurring basis until you cancel. The first payment date is your “Subscription Billing Date.” Subscription fees will be billed automatically on that date each period.

To avoid being charged for the next billing cycle, you must cancel before the renewal date. Contact us to cancel the Subscription Service.

d. Delinquent Accounts

Fieldy reserves the right to suspend or terminate access to the Service for unpaid accounts. Any costs incurred in collection efforts (including chargeback fees, legal fees, or collection agency costs) will be your responsibility.

4. Term and Termination

a. Term  

This Agreement begins when you sign up and remains in effect for the duration of your subscription. Annual subscriptions renew automatically unless you provide written notice of non-renewal at least 90 days before the end of the current term. Email notice to billing@getfieldy.com is sufficient.

Your access to the Service and stored data will terminate when your account is closed. Fieldy may terminate this Agreement at any time with 30 days’ prior written notice and will refund a prorated portion of any unused, prepaid fees.

b. Termination for Cause 

We may suspend or terminate your access to the Service immediately and without notice if:

  • You violate any terms of this Agreement.
  • You attempt to breach our security, or we determine your use poses a security threat.
  • You introduce malware or unauthorized code into the Service.
  • You disrupt or degrade the performance of the Service.
  • You use the Service in an abusive or unlawful manner; or
  • We reasonably believe you are using the Service to violate the law or infringe on third-party rights.
